The Background
In November 2021, Elena and Robert Finch settled on their house in Glenorchy, Tasmania. After considering how they could improve their house and property, they engaged a surveyor to undertake a survey of the property in November 2024.
The survey revealed that the fence they shared with their rear neighbour was encroaching onto their property. The existence of the encroachment caused Elena and Robert to lose a portion of their land and impact their development plans. In March 2025, they submitted their claim to First Title along with their survey report.
What happened next?
First Title accepted the claim under the encroachment coverage in Clause 4.5 of the Policy.
Elena and Robert then obtained fencing quotes to realign the rear boundary fence to the correct title boundary and also discussed the issue with their rear neighbour. The rear neighbour agreed to pay 50% of the cost to move the fence.
What did we do?
Elena and Robert Finch accepted our offer of $6,000 in full and final settlement of their claim. This amount represents their 50% share of the fencing quote.
