The background

Tina and Joshua Brown purchased their new home in Tasmania without visiting the site as they lived in Queensland at the time. Settlement on the home took place in May 2025.

In June 2025, the Brown family enquired with Council in relation to the approvals they’d need to commence a small business from the Property. As a result of these enquiries, it was discovered that some structures on the Property had not received the necessary permits and a Building Notice was issued. Under the Building Notice the Brown family were to obtain the relevant permit or demolish the unapproved structures. 

What happened next?

After the claim was submitted, First Title obtained the full conveyancing file and requested the property information from the Council and instructed a Building Consultant to attend the property and inspect the unapproved structures.

After our thorough investigation, First Title accepted the claim in October 2025 under the Illegal Building Work Coverage in Clause 4.6 of the Policy.

First Title paid $160,000 which is the insured amount for Illegal Building Works claims under the policy.
