Third Party Claim

Problem

One day after settlement, our client learned that he could not become the registered owner of his property due to a third party claim. The step-children of the vendor had registered a testamentary right to his property and claimed they were gifted the property in their mother’s will. The children refused to remove their interest in the property unless they received money from the sale.

Solution

First Title accepted the claim pursuant to its ‘registration gap’ coverage on the basis that between settlement and transfer to a third party, an interest was registered.

Boundary Dispute

Problem

After purchasing a block of vacant land, a survey revealed that the neighbour’s wall, eaves and awnings were encroaching on our clients land.

Solution
